AutoDataMine Acceptable Use Policy

This Acceptable Use Policy ("AUP") supplements the AutoDataMine Terms of Service and any Master Services Agreement. By using the AutoDataMine Services, the dealership and its authorized users agree not to use the Services to:
1. Violate law or third-party rights
- Send communications in violation of the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state Do-Not-Call laws, or A2P 10DLC requirements. - Process consumer non-public personal information (NPI) in violation of the Gramm-Leach-Bliley Act Safeguards Rule. - Engage in unfair, deceptive, or abusive acts or practices (UDAAP). - Infringe intellectual property, publicity, or privacy rights. - Discriminate in violation of fair lending or fair credit laws.
2. Communicate without consent
- Send SMS, voice, or other automated communications to consumers who have not given the dealership lawful prior express written consent. - Continue to message a consumer who has revoked consent or replied STOP. - Ignore HELP, START, STOP, UNSUBSCRIBE, or equivalent keywords.
3. Compromise the platform
- Attempt unauthorized access to other dealerships' Dealer Planes.
- Probe, scan, or test vulnerabilities without written authorization.
- Introduce malware, ransomware, or harmful code.
- Disrupt or degrade the Services or any other dealership's use.
4. Misuse data
- Sell, lease, or share Customer Data with parties not authorized by the dealership. - Use Customer Data for advertising unrelated to the dealership's customer relationship. - Use the Services to compile a consumer dossier outside the scope of legitimate F&I or sales operations. - Use Customer Data to train external AI models.
5. Misrepresent identity
- Spoof phone numbers, sender IDs, or email addresses. - Impersonate AutoDataMine, the dealership, an OEM, a lender, or any consumer.
6. Abuse OEM and DMS integrations
- Use OEM APIs in violation of their terms of service. - Re-query OEM APIs at a rate exceeding documented limits. - Cache or redistribute OEM data outside the dealership's permitted use.
Enforcement
We may suspend or terminate access without prior notice for material violations that present immediate risk to other dealerships, the platform, consumers, or our regulatory standing. For other violations we will provide notice and a reasonable opportunity to cure before suspension where feasible.
